Play Date Risk Agreement

waiver-MX-0.1

DRAFT: lawyers in Brazil, the US and Mexico will write the final text before launch.

What this is

You accept this for each play date your child joins, as the child’s parent or legal guardian. It explains the risks of outdoor play and who is responsible for what.

Outdoor play has risks

Running, jumping, throwing and playing outside can cause bumps, scrapes, sprains, broken bones, heat illness, insect stings and, rarely, serious injuries. Materials like balls, ropes, sticks and chalk can also cause injuries.

Who is responsible for what

Play Outside is only a planning tool. We do not organize, run or supervise play dates, and we do not inspect places or materials. The host and the responsible adult watch the children. The adult who says they will bring materials checks that they are safe. You are responsible for getting your child there and back, and for telling the responsible adult about any health need, allergy or limit.

Your choice

You choose whether your child joins. You or the responsible adult can stop a game, or take a child out, at any time.

Limit of our responsibility

As far as the law allows, you agree that Play Outside is not responsible for injuries, loss or damage that happen at play dates or that are caused by places, materials or other people. This does not cover our own gross negligence or intentional acts, and it does not take away any right that the law does not allow anyone to give up.

Emergencies

In an emergency the responsible adult calls the local emergency number first (911 in the US and Mexico; 192 ambulance or 193 fire in Brazil), then the child’s parent.
